Courts refuse to restore Pergo patent

The further attempt to reverse the revoked PERGO patent for its click laminate flooring system has been unsuccessful for a second time. The USCourt of Appeals for the Federal Circuit confirmed its earlier finding that Pergo’s products do not infringe any of the patents upon which Valinge had based its lawsuit. After more than a decade of what Pergo called ‘weak evidence’ and ‘jurisprudence’, the court found that Pergo’s products did not in fact infringe Valinge’s patents.
“This decision is in line with the decision we reported back in July,” said Ralf Eisermann, CEO of Pergo, “again shows that Pergo respects the intellectual property rights of others and will make sure that the products Pergo delivers to its customers will be protected.”
The European Patent Office revoked Pergo’s European patent EP 1 276 941 B1 in September. This patent is one of many in Pergo’s portfolio protecting FoldDown, and its granted claims cover embodiments such as those marketed as Valinge’s 5G in a number of European countries. Pergo’s other patents covering FoldDown in Europe, Asia and the United States remain valid, enforceable and unaffected by this decision.
Pergo is regarded as the inventor of HPL laminate flooring. The company produces more than 30 million square metres of laminate flooring a year at two locations in Sweden and two manufacturing facilities in the USA and Canada.
